ORDER OF THE BOARD OF ALDERS AUTHORIZING THE USE OF A MULTI-YEAR INTER-DEPARTMENTAL MOU TO FORMALIZE THE OBLIGATION OF AMERICAN RESCUE PLAN FUNDS TO THE BOARD OF EDUCATION.

WHEREAS, the Board of Alders, on November 18, 2024, approved the reallocation of previously approved ARPA project funding in the amount of $5,500,000 for the use of ARPA-designated Board of Education capital projects items for fiscal year 2024-2025; and,

 

WHEREAS, the U.S. Department of Treasury (Treasury) issued the Obligation Final Rule, providing a revision to the definition of obligations and offering guidance to provide flexibility and clarity; and,

 

WHEREAS, Treasury has defined “obligation” as “an order placed for property and services and entering into contracts, sub-awards, and similar transactions that require payment.”; and,

 

WHEREAS, Treasury considers an interagency agreement, including an agreement in the form of a memorandum of understanding (MOU), to constitute a “transaction requiring payment” similar to a contract or subaward and therefore an obligation for purposes of the ARPA rule; and,

 

WHEREAS, The Office of Policy, Management, and Grants is seeking Board of Alder approval to enter into a multi-year memorandum of understanding (MOU) with the Board of Education (BOE), for the period of July 01, 2024, through December 31, 2026, “obligating” ARPA funding previously approved by the Board of Alders.

 

NOW, THEREFORE, BE IT ORDERED by the New Haven Board of Alders that the City of New Haven, through the Office of the Mayor, can execute an inter departmental MOU with the BOE to meet the funding obligation requirement, as defined by Treasury.

 

BE IT FURTHER ORDERED THAT the City of New Haven, Board of Alders, authorizes the Mayor to execute a $5.5 million multi-year MOU with the BOE for a period of July 01, 2024, through December 31, 2026.
