ORDER OF THE NEW HAVEN BOARD OF ALDERS CONCERNING A WORKING GROUP RELATED TO AMENDING THE NEW HAVEN ZONING ORDINANCE SECTION 42 (H). USE REGULATIONS FOR BUSINESS AND INDUSTRIAL DISTRICTS AND PERSONAL GOODS TO ADD A USE CATEGORY FOR SMOKE SHOPS AND CREATING A SECTION 42.2, WHICH RESTRICTS THE SALE OF SMOKING PARAPHERNALIA.

WHEREAS: on August 1, 2022, the New Haven Board of Alders approved an amendment to the zoning ordinance to establish criteria for permitting adult use cannabis establishments; and
WHEREAS: this was a milestone piece of legislation permitting the use of recreational cannabis for adults; and
WHEREAS: since that time, there has been an increase in smoke shops throughout our city; and
WHEREAS: smoke shops are not properly regulated in our zoning code; and
WHEREAS: The City Plan Administrator has suggested that a working group be created work out details of an ordinance amendment to regulate smoke shops; and
WHEREAS: the working group should include but not be limited to staff from City Plan, Economic Development, LCI and Corporation Counsel; and
NOW, THEREFORE, BE IT ORDERED by Board of Alders of the City of New Haven, a working group be formed to prepare an ordinance amendment to the New Haven Zoning Ordinance Section 42 (H), use regulations for business, industrial districts, personal goods concerning an use category for smoke shops and creating a section 42.2, which restricts the sale of smoking paraphernalia.
BE IT FURTHER ORDERED that said working group should include but not be limited to staff from City Plan, Economic Development, LCI and Corporation Counsel
