ORDINANCE AMENDMENT OF THE NEW HAVEN BOARD OF ALDERS TO TITLE III - CODE OF GENERAL ORDINANCES, CHAPTER 29 - TRAFFIC AND MOTOR VEHICLES, ARTICLE III - PARKING, STOPPING AND STANDING, DIVISION 1, AMENDING SECTION 29-53 CONCERNING THE PARKING OF OVERSIZED AND COMMERCIAL VEHICLES IN RESIDENTIAL, PARK OR CEMETERY ZONING DISTRICTS

WHEREAS, Section 29-53 of the New Haven Code of Ordinances regulates the parking of oversized and commercial vehicles in residential, park and cemetery zoning districts; and

WHEREAS, the existing language requires clarification to ensure that the restrictions, vehicle classifications and exceptions are applied consistently; and,

WHEREAS, the proposed amendment clearly identifies the vehicles subject to the ordinance and the circumstances under which limited exceptions apply; and,

NOW THEREFORE BE IT ORDAINED by the New Haven Board of Alders that section 29-53 of the Code of Ordinances of the City of New Haven, Connecticut is hereby amended to read as follows:

Sec. 29-53. - Parking oversized trucks in residential, park or cemetery zones.
(a) No person having custody and control of a vehicle with the one (1) or more of the characteristics in subsection (b) or a vehicle as described in subsection (c) shall be permitted to park on any street in any residential, park or cemetery zoning districts as defined in the Zoning Ordinance of the City of New Haven.
(b) Vehicles prohibited are those having any one (1) of the following characteristics:
a. Gross vehicle weight or gross combination weight rating more than thousand (12,000) pounds
b. Length is more than twenty (20) feet
c. Height is more than twelve (12) feet
d. Width is more than eight (8) feet
e. Exceeds three-fourth (3/4) tons in capacity and is not used solely by the occupants of a premises and that has been prohibited by city zoning regulations from parking on or being garaged on private residential property.
