TITLE
ORDER OF THE BOARD OF ALDERS AUTHORIZING THE USE OF MULTI-YEAR INTER DEPARTMENTAL MOU’S TO FORMALIZE THE OBLIGATION OF AMERICAN RESCUE PLAN FUNDS TO VARIOUS CITY DEPARTMENTS
BODY
WHEREAS, The Board of Alders has previously approved the use of American Rescue Plan funding for various programs managed by various City Departments; and,
WHEREAS, the U.S. Department of Treasury (Treasury) issued the Obligation Final Rule, providing a revision to the definition of obligations and offering guidance to provide flexibility and clarity; and,
WHEREAS, Treasury has defined “obligation” as “an order placed for property and services and entering into contracts, sub-awards, and similar transactions that require payment.”; and,
WHEREAS, Treasury considers an interagency agreement, including an agreement in the form of a memorandum of understanding (MOU), to constitute a “transaction requiring payment” similar to a contract or subaward and therefore an obligation for purposes of the ARPA rule; and,
WHEREAS, The Office of Policy, Management, and Grants is seeking Board of Alder approval to enter into multi-year memorandums of understanding (MOU’s) with various City Departments, for the period of July 01, 2024, through December 31, 2026, “obligating” ARPA funding previously approved by the Board of Alders to these departments.
NOW, THEREFORE, BE IT ORDERED by the New Haven Board of Alders that the City of New Haven, through the Office of the Mayor, can execute inter departmental MOU’s to meet the funding obligation requirement, as defined by Treasury,
BE IT FURTHER ORDERED THAT the City of New Haven, Board of Alders, authorizes The Mayor to execute multi-year MOU’s with various City Departments for a period of July 01, 2024, through December 31, 2026.
