ORDER OF THE NEW HAVEN BOARD OF ALDERS APPROVING THE DISCONTINUANCE OF A PORTION OF PECK ALLEY BETWEEN MALTBY STREET AND DOWNING STREET TO THE EXTENT THAT THERE HAS BEEN EITHER FORMAL OR IMPLIED ACCEPTANCE OF THE ALLEY AND SAID DISCONTINUANCE IS TO ALLOW ANY ABUTTING LANDOWNER TO ASSERT ANY CLAIMS THAT THEY MAY LAWFULLY HAVE TO THE OWNERSHIP OF THE ALLEY

WHEREAS: A portion of this road was previously abandoned due to the limited use of Peck Alley; and
WHEREAS: this alley is neglected and a blight because of the lack of upkeep and maintenance; and
WHEREAS: The discontinuation of this alley will empower the abutting property owners to better maintain this area, thereby enhancing their ownership and responsibility; and
WHEREAS: this alley serves no purpose because all adjacent property owners have driveway access and off-street parking;
and
WHEREAS: the discontinuance of Peck Alley will improve the quality of life for the surrounding properties by eliminating illegal dumping; and
NOW, THEREFORE, BE IT ORDERED that the remaining portion of Peck Alley between Maltby Street and Downing Street is hereby discontinued only to the extent that there has been either formal or implied acceptance of the Alley and said discontinuance is to allow any abutting landowner to assert any claims that they may lawfully have to the ownership of the alley.
