ORDER OF THE BOARD OF ALDERS OF THE CITY OF NEW HAVEN APPROVING THE QUIT CLAIM OF EASEMENTS ENCUMBERING 18 TOWER LANE AND lB TOWER LANE.

WHEREAS, the New Haven Jewish Community Council Housing Corporation is the owner of two adjacent properties known as 18 Tower Lane and lB Tower Lane upon which Tower One and Tower East (the "Towers at Tower Lane") respectively are located; and

WHEREAS, the Towers at Tower Lane provide independent and assisted living services to elderly low- and moderate-income residents; and

WHEREAS, the New Haven Jewish Community Council Housing Corporation wishes to construct a third building ("Tower Three") to provide affordable housing and support and care services to additional members of the community so that such residents can age in place and avoid institutionalization; and

WHEREAS, the City of New Haven is the holder of an air rights easement, an open space and recreation easement and a pedestrian easement (collectively the "Easements"), all as more particularly described in the attached Quit Claim Deed (the "Quit Claim Deed"), which Easements encumber 18 Tower Lane and IB Tower Lane; and

WHEREAS, the Easements were created over forty-five (45) years ago, and the City of New Haven no longer needs such easements due to changes in circumstances, including the demolition of the Church Street South Project whose residents used certain of the Easements; and

WHEREAS, to construct Tower Three and acquire financing for the project, the New Haven Jewish Community Council Housing Corporation needs to have the Easements released by the City of New Haven.

NOW, THEREFORE, BE IT ORDERED by the Board of Alders of the City of New Haven that the Quit Claim Deed is approved.

BE IT FURTHER ORDERED that the Mayor be and herby is authorized to execute, acknowledge, and deliver on behalf of the City of New Haven the Quit Claim Deed in a form substantially similar to that attached hereto and to execute, acknowledge and deliver any ancillar...
