ORDINANCE AMENDMENT TO TITLE IV OF THE CITY OF NEW HAVEN'S CODE OF ORDINANCES, THE FLOOD DAMAGE PREVENTION ORDINANCE, AS AMENDED IN SEPTEMBER 2023, TO CORRECT INCONSISTENCY BETWEEN THIS ORDINANCE AND RECENTLY APPROVED ZONING ORDINANCE CREATING THE "LIGHT INDUSTRIAL COASTAL OVERLAY" AREA WITHIN THE MIXED-USE LONG WHARF DISTRICT.

WHEREAS, on September 18, 2023, the Board of Alders approved amendments to the City of New Haven Zoning Map and text of the Zoning Ordinance creating a new Mixed-Use Long Wharf Zoning District that included provisions for a Light Industrial Coastal Overlay to the Mixed-Use Long Wharf Zoning District;
WHEREAS, the Light Industrial Coastal Overlay to the Mixed-Used Long Wharf Zoning District specifically allowed for the continuation and expansion of certain industrial uses on property within the Special Flood Hazard Area;
WHEREAS, the amendment to the Flood Damage Prevention Ordinance, approved on September 5, 2023, is inconsistent with the Light Industrial Coastal Overlay to the Mixed-Use Long Wharf District, approved on September 18, 2023, in that it prohibits any expansion of industrial uses otherwise permitted in the Light Industrial Coastal Overlay to the Mixed-Use Long Wharf Zoning District; and
WHEREAS, the amendment proposed herein seeks to correct this inconsistency by exempting the industrial uses permitted in the Light Industrial Coastal Overlay to the Mixed-Use Long Wharf District from the general prohibition against the expansion of industrial uses in Special Flood Hazard Areas.
