ORDINANCE AMENDMENT OF THE NEW HAVEN BOARD OF ALDERS TO TITLE III - CODE OF GENERAL ORDINANCES, CHAPTER 29 - TRAFFIC AND MOTOR VEHICLES, ARTICLE III - PARKING, STOPPING AND STANDING, DIVISION 1, AMENDING SECTION 29-53 CONCERNING THE PARKING OF OVERSIZED AND COMMERCIAL VEHICLES IN RESIDENTIAL, PARK OR CEMETERY ZONING DISTRICTS

WHEREAS, Section 29-53 of the New Haven Code of Ordinances regulates the parking of oversized and commercial vehicles in residential, park and cemetery zoning districts; and
WHEREAS, the existing language requires clarification to ensure that the restrictions, vehicle classifications and exceptions are applied consistently; and,
WHEREAS, the proposed amendment clearly identifies the vehicles subject to the ordinance and the circumstances under which limited exceptions apply; and,
NOW THEREFORE BE IT ORDAINED by the New Haven Board of Alders that section 29-53 of the Code of Ordinances of the City of New Haven, Connecticut is hereby amended to read as follows:

Sec. 29-53. - Parking oversized trucks in residential, park or cemetery zones.
(a) No person having custody and control of a vehicle with the one (1) or more of the characteristics in subsection (b) or a vehicle as described in subsection (c) shall be permitted to park on any street in any residential, park or cemetery zoning districts as defined in the Zoning Ordinance of the City of New Haven.
(b) Vehicles prohibited are those having any one (1) of the following characteristics:
a. Gross vehicle weight or gross combination weight rating more than thousand (12,000) pounds
b. Length is more than twenty (20) feet
c. Height is more than twelve (12) feet
d. Width is more than eight (8) feet
e. Exceeds three-fourth (3/4) tons in capacity and is not used solely by the occupants of a premises and that has been prohibited by city zoning regulations from parking on or being garaged on private residential property.
(c) Or the following vehicles are prohibited, as described, regardless of vehicle registration type:
a. Any boat, boat trailer, utility trailer, flatbed trailer, or camper trailer, whether or not affixed or connected to another motor vehicle
b. Recreational vehicle or camper as defined by Connecticut General Statutes section 14-1
c. Any vehicle with more than four wheels exclusive of the spare tire
d. All dump trucks regardless of size
e. Tow trucks
f. All nonpassenger vehicles and/or equipment or machinery, including, but not limited to construction vehicles and equipment.
(d) This section shall not apply to:
a. Any vehicle necessary for the performance of a service in or at the nearest residence or building for a period of time not longer than is necessary for the performance of the service, except for streets within a residential parking permit zone. Service vehicles performing service within a residential parking permit zone are required to have the applicable permit displayed.
b. Any vehicle in use by a public service company, as defined by Connecticut General Statutes section 16-1, necessary for the performance of a service in or at the nearest residence or building.
c. Any vehicle in the process of making a delivery for a period of time not longer than is necessary to make the delivery.
d. Any city municipal vehicle or any vehicle parked or left standing as ordered by the police.
e. This provision is not intended to apply to vehicles that are registered as private passenger vehicles and used for, personal transportation only, including vehicles commonly referred to as “SUVs” or sport utility vehicles, family vans, or pick-up trucks.
(e) Parking a qualified vehicle in a residential, park or cemetery zone will be the violation: commercial vehicle in a residential zone.
