ORDER OF THE NEW HAVEN BOARD OF ALDERS AUTHORIZING THE MAYOR TO ENTER INTO A MULTIYEAR AGREEMENT WITH BUSPATROL AMERICA LLC TO PROVIDE SERVICES RELATED TO INSTALLATION, OPERATION, AND MAINTENANCE OF LIVE DIGITAL VIDEO SCHOOL BUS VIOLATION DETECTION MONITORING SYSTEMS (the "MONITORING SYSTEM").

WHEREAS, Public Act No. 24-107 of the 2024 Session of the Connecticut General Assembly authorizes municipalities to implement a live digital video school bus violation detection, monitoring, and enforcement system (the "Monitoring System"); and
WHEREAS, on August 4, 2025, the Board of Alders approved an ordinance amendment (OR-2025-0016) to Chapter 29, Article VII of the Code of General Ordinances, which would allow for the implementation and enforcement of the Monitoring System to improve public safety and protect children traveling to and from school; and
WHEREAS, the City issued a solicitation (2025-RFP-230) for the procurement of a qualified vendor to install, operate, and maintain such Monitoring System, in accordance with applicable procurement laws, procedures, and the specifications set forth in the ordinance and any supporting regulations; and
WHEREAS, responses to the solicitation were due on June 24, 2025 and BusPatrol America LLC was the sole respondent; and
WHEREAS, BusPatrol America LLC possesses the experience, expertise, and operational capacity to successfully implement and manage the program in compliance with the ordinance and applicable state law; and
WHEREAS, the City recognizes that entering into a multi-year agreement may be necessary and in the best interest of the City to ensure effective, uninterrupted operation, maintenance, and management of the Monitoring System; and
WHEREAS, the Board of Alders seeks to authorize the Mayor of the City of New Haven to negotiate and execute such an agreement with BusPatrol America LLC.
NOW, THEREFORE, BE IT ORDERED by the Board of Alders of the City of New Haven that:
1. The Mayor of the City of New Haven, or the Mayor's designee, is hereby authorized to negotiate, execute, and deliver, on behalf of the City, a multi-year agreement with BusPatrol America LLC for the installation, operation, and maintenance of the live digital video school bus violation detection monitoring system, pursuant to Public Act 24-107 and Chapter 29, Article VII of the New Haven Code of General Ordinances; and,
2. Such agreement may include, but need not be limited to, provisions regarding compensation for services, reimbursement of equipment and installation costs, performance standards, reporting requirements, compliance with applicable law, and remedies for breach; and,
3. The term of the agreement shall not exceed three (3) years, and may include renewal or extension provisions, subject to mutual agreement of the parties and approval by the Board of Alders, where required; and,
4. The Mayor of the City of New Haven, or the Mayor's designee, is further authorized to take all actions and execute all documents necessary or incidental to carry out the purposes of this resolution, including the execution of amendments or modifications that do not materially change the scope, term, or financial obligations of the agreement; and,
5. This Order shall take effect immediately upon passage.
