ORDER OF THE NEW HAVEN BOARD OF ALDERS AUTHORIZING THE OFFICE OF THE CORPORATION COUNSEL TO ENTER INTO A MULTI-YEAR PRODUCT AND SERVICE AGREEMENT WITH ISO CLAIMS PARTNERS, INC. TO SUBSCRIBE TO MSP NAVIGATOR AND RELATED SERVICES, A SYSTEM FOR REPORTING BODILY INJURY CLAIM DATA OF MEDICATE ELIGIBLE CLAIMANTS TO THE CENTERS FOR MEDICARE & MEDICAID SERVICES (CMS) FOR THE PURPOSE OF FACILITATING CUSTOMER COMPLIANCE WITH SECTION 111 OF MEDICARE, MEDICAID AND SCHIP EXTENSION ACT OF 2007, P.L. 110-173 (“SECTION 111”).

WHEREAS, ISO Claims Partners, Inc. notified the Office of the Corporation Counsel of the City of New Haven that ClaimSearch CMS will be ending its system for reporting the bodily injury claim data of Medicare eligible claimants to the Centers for Medicare & Medicaid Services (“CMS”); and
WHEREAS, ISO Claims Partners, Inc. notified the Office of the Corporation Counsel of the City of New Haven of its new system for Medicare reporting, called MSP Navigator; and
WHEREAS, the Office of Corporation Counsel has reviewed and authorization by the Board of Alders is required for the Mayor to sign the Product & Service Agreement for the MSP Navigator system containing the multi-year term of 36 months with one-year automatic renewals; and
WHEREAS, ISO Claims Partners Inc has a state of Connecticut contract #ADMN2500199; and
WHEREAS, the Office of Corporation Counsel has reviewed and authorization by the Board of Alders is required for the Mayor to sign the Product & Service Agreement for the MSP Navigator system containing the indemnification clause to indemnify, defend and hold harmless ISO Claims Partners, Inc. and its directors, officers, employees and subcontractors from and against any damages, liabilities and expenses (including, but not limited to reasonable attorneys’ fees) incurred by ISO Claims Partners, Inc.; and
WHEREAS, the Office of Corporation Counsel anticipates that the new system, MSP Navigator, with ISO Claims Partners, Inc. to be more efficient, reliable, and timely to perform the Mandatory Section 111 claims reporting to CMS; and
WHEREAS, it is expected that the funds are available for these future Service Agreements from line item GF 11331010-56694 in FY 2025-2026 , 2026-2027, 2027-2028 with three (3) one-year renewal options.
NOW, THEREFORE, BE IT ORDERED by the Board of Alders of the City of New Haven authorizes the execution of a multi-year agreement between the City of New Haven and ISO Claims Partners, Inc. for its MSP Navigator reporting system; and
BE IT FURTHER ORDERED by the Board of Alders of the City of New Haven that the Mayor of the City of New Haven is authorized to execute the Agreement as well as any such additional instruments, indemnities or amendments as necessary or expedient to implement the agreement.
