ORDER OF THE NEW HAVEN BOARD OF ALDERS APPROVING AMENDMENT NO. 2 TO THE OUTSIDE LEGAL SERVICE AGREEMENT WITH THE LAW FIRM OF KARSTEN & TALLBERG, LLC TO INCREASE THE TOTAL AGREEMENT AMOUNT BY SEVENTY-SEVEN THOUSAND TWO HUNDRED FORTY THOUSAND DOLLARS AND TWO CENTS ($77,240.02) FOR FY 2025-2026.

WHEREAS, Section 2-162 of the Code of General Ordinances requires Leadership of the Board of Alders approval for any city legal services contract that does not go to bid that costs less than one hundred fifty thousand dollars and zero cents ($150,000.00); and
WHEREAS, Section 2-376 (A) of the Code of General Ordinances requires Board of Alders approval for any city contract that does not go to bid that costs more than one hundred fifty thousand dollars and zero cents ($150,000.00); and
WHEREAS, on June 11, 2025, the Office of Corporation Counsel for the City of New Haven, (“Corporation Counsel”) submitted a letter to the Leadership of the Board of Alders (“Leadership”) pursuant to Section 2-162 of the Code of Ordinances of the City of New Haven, and received Leadership approval to enter into a Legal Service Agreement (2025-CON-0243) with the law firm of Karsten & Tallberg, LLC in the amount of one hundred forty-nine thousand dollars and zero cents ($149,000) from FY 2025-2026 GF 11331010-56696; and
WHEREAS, on November 20, 2025, the Office of Corporation Counsel for the City of New Haven, (“Corporation Counsel”) submitted a package to the Board of Alders (“Board of Alders”) pursuant to Section 2-376 (A) of the Code of Ordinances of the City of New Haven, and received Board of Alders approval to enter into Amendment No. 1 to the legal service agreement (2026-CON-0047) with the firm of Karsten & Tallberg, LLC to increase the total amount of the agreement by one hundred thirty three thousand dollars and zero cents ($133,000) from FY 2025-2026 GF 11331010-56696, for a new agreement total of two hundred eighty two thousand dollars and zero cents ($282,000); and
WHEREAS, on October 1, 2026, the Office of Corporation Counsel for the City of New Haven, (“Corporation Counsel”) submitted a second package to the Board of Alders (“Board of Alders”) pursuant to Section 2-376 (A) of the Code of Ordinances of the City of New Haven, requesting Board of Alders approval to enter into Amendment No. 2 to the legal service agreement with the firm of Karsten & Tallberg, LLC to increase the total amount of the agreement by seventy seven thousand two hundred forty dollars and two cents ($77,240.02) from FY 2025-2026 GF 11331010-56696, for a new agreement total of three hundred fifty nine thousand two hundred forty dollars and two cents ($359,240.02); and
WHEREAS, the Office of Corporation Counsel legal service budget is not projected to go over budget for FY 2025-26; and
WHEREAS, Amendment No. 2 to the legal service agreement of Karsten & Tallberg, LLC will exceed $150,000 for FY 2025-2026; and
WHEREAS, the funds are available for Amendment No. 2 to the outside legal service agreement with Karsten & Tallberg, LLC, from budgeted, unused outside counsel funds of the Corporation Counsel for FY 2025-2026 GF 11331010-56696.
NOW THEREFORE BE IT ORDERED by the New Haven Board of Alders that Amendment No. 2 to outside legal service agreement with Karsten & Tallberg, LLC for FY 2025-2026 be and hereby is approved; and
BE IT FURTHER ORDERED by the New Haven Board of Alders that the City Budget Director or Controller is hereby authorized to draw down $77,240.02 in budgeted, unused outside counsel funds of the Corporation Counsel for FY 2025-2026 GF 11331010-56696 to execute Amendment No. 2 to outside legal service agreement with Karsten & Tallberg, LLC for FY 2025-2026.
