ORDINANCE AMENDMENT OF THE NEW HAVEN BOARD OF ALDERS TO APPROPRIATING ORDINANCE # 1 AUTHORIZING BUDGET TRANSFER #133-26-1 TRANSFERRING FUNDS FROM THE SALARY ACCOUNTS OF PUBLIC WORK’S DEPARTMENT, OFFICE OF POLICY, MANAGEMENT & GRANTS, HEALTH DEPARTMENT, OFFICE OF BUILDING INSPECTION & ENFORCEMENT, MAYOR’S OFFICE, REGISTRAR OF VOTERS, FINANCE, CITY PLAN DEPARTMENT, ACCOUNTING, AND MISCELLANEOUS LINES AND TRANSFERRING TO CORPORATION COUNSEL LEGAL SERVICE BUDGET IN THE AMOUNT OF $1,435,000 AND AMENDING THE LEGAL SERVICE AGREEMENTS OF HOWD & LUDORF; KARSTEN & TALLBERG, MACCINI & VOCCIO; MILANO & WANAT; WILLIAM MELLEY, ESQUIRE; ROSE KALLOR, RYAN, RYAN & DELUCA; AND WILLIAMS, WALSH & O’CONNOR, IN EXCESS OF ONE HUNDRED FIFTY THOUSAND DOLLARS

WHEREAS, Article VIII, Section 3 of the City Charter and Section 2-383 (1) of the Code of General Ordinances requires the approval of the Board of Alders for the transfer of funds within the General Fund Operating Budget, as adopted; and
WHEREAS, Section 2-376 (A) of the Code of General Ordinances requires Board of Alders approval for any city contract that does not go to bid that costs more than one hundred fifty thousand dollars ($150,000.00); and
WHEREAS, The Office of Corporation Counsel legal service account is projected to go over budget for fiscal year 2025-2026; and
WHEREAS, The legal service agreement for Howd & Ludorf (#60260018) will be amended from
$149,000 to $644,000 for fiscal year 2025-2026; and
WHEREAS, The legal service agreement for Karsten & Tallberg (#60260036) will be amended from $149,000 to $282,000 for fiscal year 2025-2026; and
WHEREAS, The legal service agreement for Maccini & Voccio (#60260037) will be amended from $149,000 to $176,000 for fiscal year 2025-2026; and
WHEREAS, The legal service agreement for William Melley, Esquire (#60260016) will be amended from $99,500 to $235,500 for fiscal year 2025-2026; and
WHEREAS, The legal service agreement for Milano & Wanat (#60260014) will be amended from $149,000 to $239,000 for fiscal year 2025-2026; and
WHEREAS, The legal service agreement for Rose Kallor (#60260046) will be amended from
$50,000 to $69,000 for fiscal year 2025-2026; and
WHEREAS, The legal service agreement for Ryan, Ryan & DeLuca (#60260048) will be amended from $10,000 to $525,000 for fiscal year 2025-2026; and
WHEREAS, The legal service agreement for Williams Walsh & O’Connor (#60260013) will be amended from $75,000 to $95,000 for fiscal year 2025-2026; and
WHEREAS, The City of New Haven Public Work’s Department, Office of Policy, Management & Grants, Health Department, Office of Building Inspection & Enforcement, Mayor’s Office, Registrar of Voters, Finance, City Plan Department, Miscellaneous and Accounting are projecting to have lapsed salary to cover the additional cost for legal expenditures for fiscal year 2025-2026; and
WHEREAS, The City of New Haven Office of Police Management & Grants is seeking to transfer funds from Miscellaneous line AMR and Non-Public Transportation to cover the additional cost for legal expenditures for fiscal year 2025-2026.
NOW, THEREFORE, BE IT ORDAINED by the New Haven Board of Alders that:
Section 1. Transfer #133-26-1 be approved to transfer ($1,435,000) to the Office of Corporation Counsel legal service account.
Section 2. The legal services agreements for Fiscal Year 2025-26 between the City of New Haven and various outside law firms are hereby amended to increase the maximum allowed expenditures of:
Howd & Ludorf from $149,000 to $644,000,
Karsten Tallbert from $149,000 to $282,000,
Maccini & Votre from $149,000 to $176,000,
William Melley, Esquire from $99,500 to $235,500,
Milano & Wanat from $149,000 to $239,000,
Rose Kallor from $50,000 to $69,000,
Ryan, Ryan & DeLuca from $10,000 to $525,000, and
William Walsh from $75,000 to $95,000.
