ORDER OF THE BOARD OF ALDERS OF THE CITY OF NEW HAVEN AUTHORIZING THE MAYOR OF THE CITY OF NEW HAVEN TO INDEMNIFY, DEFEND AND HOLD HARMLESS THE STATE OF CONNECTICUT FROM AND AGAINST ANY AND ALL CLAIMS AND LIABILITIES ARISING IN CONNECTION TO THE CONTRACT FOR THE RAPID DNA PROGRAM BETWEEN THE CONNECTICUT DEPARTMENT OF EMERGENCY SERVICES AND PUBLIC PROTECTION DIVISION OF THE SCIENTIFIC SERVICES AND THE NEW HAVEN POLICE DEPARTMENT.

WHEREAS, the NHPD was awarded a federal Crime Gun Intelligence Center (CGIC) grant to create a real time state-of-the art command and control environment using technology and design to improve its operations to detect and respond to firearm-related violent incidents; and

 

WHEREAS, CGIC grant funding enabled the Department to purchase a Rapid DNA Machine to process DNA samples from body fluids obtained by suspects/offenders for investigative leads. Investigative leads help solve crimes faster by giving officers actionable leads in real time and reducing the time for evidence tampering or allowing an offender to escape; and

 

WHEREAS, the State of Connecticut Department of Emergency Services and Public Protection Division of Scientific Services Division of Scientific Services (CT DESPP DSS) Rapid DNA Program has access to the Connecticut Offender Database and is authorized to conduct searches and to verify whether an individual qualifies to be in the database pursuant to Conn. Gen. Stat. Sec. 54-102g; and

 

WHEREAS, NHPD can submit its DNA samples to the CT DESPP DSS and request that it conduct a search of the Database on its behalf with regard to certain identified offender(s), and that upon receiving an offender identity, can use that information for investigative purposes; and

 

WHEREAS, CT DESPP DSS and the NHPD have developed an “Agreement” to establish the terms, conditions, and safeguards under which CT DESPP DSS will provide the NHPD with results from searches requested by NHPD in conjunction with the CT DESPP DSS Rapid DNA Program; and

 

WHEREAS, CT DESPP DSS Rapid DNA Program has requested to be indemnified, defended and held harmless by the City of New Haven against claims and liabilities arising in connection with this Agreement; and

 

WHEREAS, the Board of Alders supports the Agreement between CT DESPP DSS and the NHPD to enhance public safety needs of the City of New Haven; and

 

NOW, THEREFORE BE IT RESOLVED THAT the Board of Alders of the City of New Haven authorizes the Mayor of the City of New Haven to indemnify the CT DESPP DSS for the term of the Agreement with the NHPD, and to execute all documents as necessary.
