ORDER OF THE NEW HAVEN BOARD OF ALDERS AUTHORIZING THE MAYOR TO EXECUTE A ONE-YEAR CONTRACT EXTENSION WITH UNITED WAY OF GREATER NEW HAVEN FOR THE PERIOD OF SEPTEMBER 1, 2025 TO DECEMBER 31, 2026 TO PROVIDE CITYWIDE LITERACY AND MATH PROGRAMMING TO NEW HAVEN PUBLIC SCHOOL STUDENTS UNDER THE LITERACY AND MATH TUTORING INITIATIVE FUNDED BY THE AMERICAN RESCUE PLAN ACT.

WHEREAS, the City of New Haven (“the City”) and the Contractor (“United Way of Greater New Haven”) entered into Agreement A23-0833 (the “Agreement”), for the Contractor to provide the City with Citywide literacy and math programming to New Haven Public School students; and

 

WHEREAS, the Contract Period and services to be provided by the Contractor are outlined in an Order of the Board of Alders of New Haven duly passed on June 5, 2023, which Order became effective upon its signature by the Honorable Justin Elicker, Mayor of the City of New Haven on June 20, 2023 (LM 2023-0324); and

 

WHEREAS, the City and the Contractor desire to amend the Agreement to extend the term of the Agreement in accordance with the Order No. LM 2023-0324 (this “Amendment”); and

 

WHEREAS, American Rescue Plan Act funds for this Amendment remain available for the Agreement, as amended, through Board of Alders adoption of the FY25-FY-26 City Budget.

 

NOW THEREFORE BE IT ORDERED by the New Haven Board of Alders that for good and valuable consideration, the sufficiency and receipt of which is hereby acknowledged, the City and the Contractor mutually agree to amend the Agreement as followed:

 

1.

Section 2.11 is deleted in its entirety and replaced with:

 “Subaward Agreement Period” means June 1, 2023 to August 31, 2026. Unless specifically authorized otherwise in this Agreement, all expenditures under this Agreement must before costs or expenses incurred by Subrecipient after March 3, 2021. It is understood by the Parties that the City must obligate all ARPA funds by December 31, 2025 and the City must expend all ARPA funds by December 31, 2026.

Any and all other provisions of the Agreement that are required to be amended in order to effectuate and/or further the purposes of this Amendment that have not been specifically and expressly amended by this Amendment are hereby amended so that they will effectuate and/or further the purposes of this Amendment.

 

3.

EXCEPT AS MODIFIED HEREIN BY THIS AMENDMENT, all terms and conditions of the Agreement remain unchanged and in full force and effect.

 

BE IT FURTHER ORDERED that the Board of Alders of the City of New Haven authorizes the City to draw down from the from the American Rescue Plan, local fiscal recovery fund in the amount of $1.5M for the purposes of providing literacy and math tutoring to New Haven Public School students.
